Article 1 - Purpose

The purpose of these General Terms and Conditions of Sale is to define the contractual relationship between MilkyCream, hereinafter referred to as "the Seller," and any natural or legal person wishing to make a purchase via the website www.milkycream.com, hereinafter referred to as "the Customer."

Article 2 - Products

The products offered are those listed on the website. Each product is presented with a detailed description. The photographs are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially regarding colors.

The packaging, format, or supplier of a product may be modified without affecting its composition or quality of use.

These variations do not affect the conformity of the product.

Article 3 - Prices

Prices are indicated in euros, all taxes included (TTC). The Seller reserves the right to modify its prices at any time, it being understood that the price appearing on the website on the day of the order will be the only one applicable to the buyer.

Shipping costs are indicated before the final confirmation of the order.

Article 4 - Order

The Customer places their order on the website, following the online purchase process. The confirmation of the order implies acceptance of these General Terms and Conditions of Sale and constitutes proof of the purchase contract.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning the payment of a previous order.

Article 5 - Payment

Payment is made securely online by credit card or any other means of payment offered on the website. The credit card is debited at the time of order confirmation.

Article 6 - Delivery

Products are delivered to the address indicated by the Customer during the order. Delivery times are indicated at the time of the order and are given for information only.

Article 7 - Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to give reasons or pay penalties.

To exercise this right, the Customer must notify their decision to the Seller by email at contact@milkycream.com.

Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) to allow their re-marketing as new.

Article 8 - Guarantees

All products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for in articles 1641 et seq. of the Civil Code.

Article 9 - Liability

The Seller cannot be held liable for the non-performance of the contract in the event of stock shortage, unavailability of the product, or in the event of force majeure.

Article 10 - Personal Data

The information collected when ordering is necessary for its processing. It is intended for the Seller and its service providers. In accordance with the GDPR, the Customer has a right of access, rectification, and deletion of their personal data by contacting contact@milkycream.com.

Article 11 - Intellectual Property

All elements of the www.milkycream.com website are and remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound.

Article 12 - Disputes

These General Terms and Conditions of Sale are subject to German law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, only the German courts will be competent.
